Personal Injury Claim Case Study
A woman has been awarded £3,800 compensation after she was pinned to a wall by a bus that was reversing on a narrow street.
The accident happened when the woman was walking along the pavement with her daughter. The bus was turning right and swung too far. The back end of the bus came on to the pavement and trapped her against a wall. She was unable to move and had to push her daughter into the wall to protect her and prevent her from falling under the bus.
The woman, who is 45, suffered injuries to her knee, back and left shoulder. Her hands became badly swollen. The pain in her shoulder and hands settled after a few weeks, but the pain in her knee lasted several months. She was unable to take part in exercise classes due to the pain.
She took legal action against the bus company, alleging that the driver was negligent in failing to keep a look-out for pedestrians.
The company admitted liability and agreed to an out-of-court settlement of £3,800.
